1) Can I have copies of every host community agreement approved for recreational marijuana businesses.

Please see attached.

2) Are there host community agreements currently under negotiation, but not approved by the town? If so, can you share for what type of recreational business - dispensaries, cultivators, product manufacturers, labs, micro businesses, transporters or any other licenses.

Yes, cultivation/processing.

3) Has your community received a subpoena from US Atty for Massachusetts Andrew Lelling's office to investigate your host community process?

To the extent that the Town has received any such subpoena, it will be withheld from disclosure pursuant to G.L. c.4, §7, clause 26, and particularly, exemptions (a) (in accord with the federal rules of criminal procedure), (d) (relates to ongoing matter) and (f) (relates to an ongoing investigation).  Any such subpoena would relate to an ongoing grand jury proceeding being conducted by the U.S. Attorney’s Office in the U.S. District Court for the District of Massachusetts, pursuant to Fed.R.Crim. P. 6.  Please be advised that the U.S. Attorney’s Office has specifically requested that any such subpoena not be produced in response to a public records request.  As such, the Town is unable to provide a copy of any subpoena it may have received in response to the request, as it cannot compromise such grand jury proceedings.  You may wish to contact the U.S. Attorney’s Office for further information.

You may appeal this response to the Supervisor of Public Records pursuant to 950 CMR 32.08(1)(d).  By law, the Supervisor is required to respond within 10 business days of receipt of your appeal.  You may also seek judicial review of an unfavorable response by commencing a civil action in the superior court, under G.L. c. 66, §10A(c).

4) Regardless of your answer above, has your community stopped or paused negotiating or issuing host community agreements with potential recreational marijuana businesses since the beginning of November?

5) Does your community require recreational marijuana businesses have a location secured and a special permit in hand before a host community can be approved by the town?

No, the Town does not.
